Heard learned counsel for the petitioner and the learned Standing Counsel for the State-respondents.
Leave to implead the claimant as sought is granted. Necessary impleadments be carried out forth with.
The petitioner who was arrayed as a respondent in the claim instituted before the Tribunal suffered an ex parte award. He is thereafter stated to have moved an application for recall on 12 August 2010. That application itself came to be dismissed for want of prosecution in 2013. Sri Pandey points out that although an application for recall of that order has been preferred, the same is pending consideration before the Tribunal. In the meanwhile, a recovery certificate is stated to have been issued against the petitioner. In that view of the matter, the ends of justice would merit this petition being disposed of with a direction to the Additional District Judge, Court No. 1, Bhadohi, at Gyanpur before whom Claim Petition No. 48 of 2003 (Chhote Lal Vs. Awadh Nath Shukla & Another) is stated to have been filed, to attend to the application for restoration as moved by the petitioner and endeavour to dispose it of with expedition with due notice to all parties including the respondent No. 2 here and preferably within a period of one month from the date of presentation of a certified copy of this order.
The petition stands disposed of accordingly.
