Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
Challenge in the writ petition is three orders passed by the mutation Courts upholding PA-11 entries made in favour of the respondents and dismissing the consequential appeal and revision filed by the petitioner.
It is also admitted that the petitioner has already filed a suit for declaration under Section 229B of the U.P. Zamindari Abolition and Land Reforms Act, which is already pending.
Under the circumstances and since, the mutation proceedings are purely fiscal in nature and do not determine the title of the parties, thereto and petitioner has already instituted a title suit under Section 229B of the Act, this Court does not find any justification to interfere in the matter.
The writ petition is disposed of with the observation that the orders impugned shall necessarily abide by the final orders passed in a declaratory suit under Section 229B of the U.P. Zamindari Abolition and Land Reforms Act.
