Heard Sri Yogesh Srivastava, learned counsel for the petitioner and Sri Amit Sinha, learned A.G.A. for the respondent nos. 1 to 3.
This writ petition has been filed by the petitioner seeking quashment of FIR dated 07.12.2018 in respect of Crime No.1134/2018 for the offence under Sections 302, 307 of IPC, P.S. Sector-39, Noida, District Gautam Budh Nagar.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and though he has been named in the FIR, but till date no evidence against him has been collected by the prosecution.
Opposing this submission, it has been argued by learned State Counsel that the FIR under Sections 302 and 307 of IPC has been registered against the petitioner and two other co-accused and specific role to the petitioner has been duly assigned in the FIR.
Considering the serious nature of allegations levelled against the petitioner, we are not inclined to entertain this writ petition. Writ Petition is, accordingly, dismissed.
