Heard learned counsel for the parties.
The petitioner is before this Court assailing the order dated 19.05.2018 passed in O.S. No.144 of 2013 (Air Plaza Retail Holding Pvt. Ltd. v. Sri Hariram Srivastava & Anr.) by Civil Judge (SD), Bareilly.
Shri Pranjal Mehrotra, learned counsel for contesting respondents raised a preliminary objection regarding the maintainability of the writ petition on the ground that against the order impugned the petitioner has alternative efficacious remedy and as such the writ petition is liable to be dismissed.
The Court has proceeded to examine the record in question and find substance in the objection raised by learned counsel for contesting respondents.
The writ petition is dismissed on the ground of alternative remedy. Certified copy of the order be returned to learned counsel for the petitioners.
