The petitioner is claiming pensionary benefits on the premise that an employee namely Sri Mohd. Smile Ali has been accorded benefit of pension scheme applicable to the Collection Amin/Clerk working in the office of Assistant Commissioner/Assistant Registrar (Cooperative).
Only submission made during the course of argument is to issue a direction to respondent to consider the claim of the petitioner submitted vide representation dated 28.3.2019.
Sri Satyam Singh, learned Standing counsel appearing for respondent nos.1 to 5 submits that since the petitioner had retired in the year 2013 the pension scheme is not admissible to him, however, claim for other retiral dues can be considered.
Without expressing any opinion as to the merits of the claim of the petitioner, the present petition is being disposed of with the direction to respondent no.5, Assistant Commissioner/ Assistant Registrar, (Cooperative), Firozabad to decide the claim of the petitioner by passing a reasoned and speaking order in accordance with law, preferably, within a period of two months from the date of submission of certified copy of this order.
