Heard Sri Sujeet Kumar Rai, learned counsel for the petitioner. Sri H.R.Mishra, learned Senior Counsel has appeared for the respondent no. 3.
The petitioner alleges that he is one of the members of the General Body of 509, Army Base Workshop Worker Cooperative Housing Society Ltd. Agra. He wants an inquiry by the Registrar in accordance with Section 65 of the U.P. Cooperative Societies Act, 1965.
Submission is that though the petitioner along with some other persons have approached the Registrar for the inquiry, no inquiry in the matter of irregularities committed by the office bearers of the Society is being conducted.
It may be noticed that under Section 65 of the Act, 1965 an inquiry may be held by the Registrar or any person authorized by him in writing in this behalf inter alia on the application of not less than one-third of the total members of the society.
We do not find from the record of the petition that one third of the total members of the Society have made any application for holding the inquiry.
The writ petition has been filed by a solitary member and no other member has joined the petitioner in filing the same.
In view of the above we do not find any good ground for issuing any direction for holding the enquiry. The petitioner may pursue the remedies which may be available to him under law.
The writ petition is disposed of.
