This writ petition is filed challenging the interim order dated 24.8.2020 pasaed by the Tehsildar, Tehsil - Sadar, District - Gorakhpur under the proceedings under Section 34/35 of U.P. Land Revenue Act. For ready reference, the same is produced hereinafter : -
"आववेदक ससंजय सससंह व ससुभभावतती शसुक्लभा दभारभा सजलभासधिकभारती गगोरखपसुर महगोद कगो ससंबगोसधित पभाशरनभा पत्र पर सजलभासधिकभारती महगोदय दभारभा पभाररत पपृषभासंकन आदवेश ददनभासंक 10.7.2020 कवे क्रम मम पत्रभावलती कभा अवलगोकन दकयभा। अवलगोकन सवे स्पष्ट हहै दक हररश्चन्द्र दभारभा आधिभार कभारर व वगोटर कभारर दभासखल नहहीं दकयभा गयभा हहै। आदवेश ददनभासंक 6.3.2020 उक्त सभाक्ष्य कवे अभभाव मम त्रदटपपूरर ढसंग सवे पभाररत हहै जगो वभापस हगोनवे यगोग्य हहै। अततः आदवेश ददनभासंक 6.3.2020 वभापस सलयभा जभातभा ह। सक्ष्य ददनभासंक 16-9-2020 कगो पस्तसुत कर।वे "
आदवेश कभा असंकन हगो। उभयपक्ष अपनती आपसत्ति / The order dated 6.3.2020, referred above, is also reproduced hereinafter :-
"पत्रभावलती कभा अवलगोकन दकयभा। अवलगोकन सवे स्पष्ट हहै दक पपूवर पभाररत आदवेश ददनभासंक 24-5-78 त्रसुदटपपूरर पततीत हगोतभा हहै। अततः न्यभायदहत मम आदवेश ददनभासंक 24-5-78 कभा दक्रयभान्वयन व पभभाव आदग्रिम आदवेश तक स्थदगत दकयभा जभातभा ह। असंकन कभा कगो नगोदटस जभारती हगो। पत्रभावलती ददनभासंक 23.3.2020 कगो पशवे हगो।"
Learned counsel for petitioner submits that impugned order is passed on the basis of an order passed by the Collector on application, submitted before him. There is no application for modification or recall of the order dated 6.3.2020 before the concerned Tehsildar, therefore, the impugned order is illegal.
Shri Govind Narain Srivastava, learned Standing Counsel has fairly submitted that there was no application before the Tehsildar to recall the order dated 16.9.2020 by way of passing the impugned order.
Shri Satyawan Shahi, learned counsel for private respondent has submitted that there are allegation of fraud against the petitioner and he may be permitted to file recall application before the concerned authority.
Considered the submissions of learned counsel for parties.
The impugned order, passed by concerned Teshsildar, is only on the basis of a communication of the Collector and not passed on any application, moved on behalf of any aggrieved party, which is apparently without any Authority and not sustainable in the eye of law. However, the private respondents are at liberty to file recall application, if so adviced, before the concerned authority.
Accordingly, the impugned order dated 24.8.2020, passed by the Tehsildar, Tehsil Sadar, Gorakhpur is set aside and this writ petition is disposed of with a direction to the Competent Authority to decide the proceedings of Case No.RST/03226/2020 being Computerized Case No. T202005310303226 (Harish Chandra vs. Siya Nand), under Sections 34/35 Land Revenue Act, expeditiously, preferably within a period of three months from today provided there is no legal impediment.
