Heard learned counsel for the parties.
This is an application by the petitioner for being granted six months time to vacate the shop in dispute in pursuance of judgment of this Court dated 18.04.2019. It is stated in the affidavit that the petitioner's wife is a heart patient and it would take some time to find out an alternative accommodation.
The application is allowed in part. Time upto 30th September 2019 is granted to the petitioner to vacate the disputed shop, provided he files an undertaking before the prescribed authority within one week to the above effect. In the undertaking, he shall also specifically state that he would not induct any third party in the shop in dispute and would pay rent to the landlord regularly by 7th of each month.
In case of default, the protection granted to him shall stand automatically vacated, and it shall be open to the respondent landlord to execute the eviction order forthwith.
