[1] Heard learned advocates for the respective parties. It is jointly submitted by learned advocates for the respective parties that if necessary direction is given to Trial Court to dispose of the Special Civil Suit No.6 of 2009 within stipulated time, then, they do not invite any reasoned order. It is further submitted by learned advocates appearing for the respective parties that if interim relief granted by this Court (Coram : Hon'ble Mr.Justice K.S.Jhaveri) is Civil Application No.10363 of 2010 is continued till final disposal of the Suit, they would not have any objection.
[2] Under the circumstances, interim relief granted by this Court (Coram : Hon'ble Mr. Justice K.S.Jhaveri) by order dated 17.01.2011 in Civil Application No.10363 of 2010 is hereby continued till final disposal of Special Civil Suit No.6 of 2009.
[3] Learned Principal Senior Civil Judge, Gandhidham Court is hereby directed to dispose of Special Civil Suit No.6 of 2009 and connected applications preferred by the parties in accordance with law and without being influenced by the order passed by the Trial Court below Exh.5 as well as order passed by this Court today, within a period of one year from the date of receipt of present order.
[4] In view of above, both the Appeal from Order and Civil Application are disposed of.
