Present application has been preferred by the applicants herein - original appellants to restore the Second Appeal No.51 of 2012 which came to be dismissed by this Court for non-prosecution.
Having heard Shri Mansuri, learned advocate appearing on behalf of the applicants and considering the averments in the application and on assurance given by Shri Mansuri, learned advocate appearing on behalf of the applicants that as and when Second Appeal is taken up for admission hearing, he will remain present and argue out the case, present application is allowed and Second Appeal No.51 of 2012 is hereby ordered to be restored to file. Rule is made absolute accordingly.
