Heard learned counsel for the applicant and learned AGA for the State.
The present application has been filed for to decide the bail application of the applicant in case no. 4175 of 2017 arising out of case crime no. 15 of 1986, under Section 376 and 506 IPC, P.S. Pakbara, District Moradabad pending before ACJM-II, Moradabad.
This is second application filed by the applicant. The earlier application was disposed of on 16.08.2018 by the coordinate Bench of this Court.
I am not inclined to exercise my discretion in favour of the applicant as the second application is not maintainable for the same cause of action.
Accordingly, the application is hereby rejected.
