Heard learned counsel for the parties.
The primary prayer made in the writ petition, reads thus:
"A. A writ order or direction in the nature of ceritorari for quashing the F.I.R. dated 27.4.2016 in case crime no.136 of 2016 under section 493, 376, 313 I.P.C. P.S. Refinery, District Mathura (Annexure no.1 to this writ petition)."
Mr. Syed Ali Murtaza, learned AGA, on instructions, submits that a Charge Sheet, bearing no.167/2017 dated 29.09.2017 has already been filed, and in view thereof, this petition renders infructuous.
The petition is, accordingly, disposed of as infructuous. It is, however, open to the petitioners to take appropriate remedy, if they so desire and are advised, for appropriate relief.
