The instant writ petition has been filed challenging the order of District Inspector of Schools dated 31.1.2018 by which election of Committee of Management held on 6.1.2018 in the presence of observer has been approved and signature of the Manager has been attested. The petitioner has also challenged the election dated 6.1.2018. The election is in respect of constitution of the Committee of Management of D.A.V. Inter College, Ghazipur, a recognised institution under the provisions of the U.P. Intermediate Education Act, 1921.
After hearing counsel for the petitioner, this Court is not inclined to interfere with the impugned order or to examine the validity of the elections in exercise of power under Article 226 of the Constitution of India. The petitioner is a single member and no one else has come forward to challenge the election. This is another reason why this Court declines to examine the challenge in exercise of writ jurisdiction.
The writ petition is accordingly disposed of with liberty to the petitioner to seek remedy by approaching the Regional Level Committee or such other forum, as may be advised.
