Heard learned counsel for the petitioners and learned counsel for the State.
By this petition, the petitioners have prayed for following reliefs:-
(i) a writ, order or direction in the nature of MANDAMUS commanding and directing the respondents authorities either to pay in favor of the petitioners the compensation of the land bearing Khasra No. 606 Area 0.1770 hectare situated in Revenue Village Kirachpur, Pargana and Tehsil Dadari, District Gautam Budh Nagar unlawfully taken by the Greater NOIDA Industrial Development Authority or to release the said land to the petitioners forthwith.
(ii) a writ, order or direction in the nature of MANDAMUS commanding and directing the respndent no.3 to consider and decide the pending representation dated 17.09.2019 of the petitioners within stipulated period as deem fit and proper by this Hon'ble Court."
It is stated by the counsel for the Greater NOIDA Industrial Development Authority that they had not taken any possession of the land in question belonging to the petitioners being Khasra No. 606 situated in revenue village Kirachpur, Pargana, Tehsil Dadri, District Gautam Budh Nagar.
As it is asserted that land is without any unlawful encroachment, we direct the respondent no.2 to see that the representation made by the petitioners is decided as expeditiously as possible as learned counsel for the NOIDA Industrial Development Authority has made oral categorical statement that they have yet not taken possession of the said land. Decision be taken within six weeks from today as the matter is pending since 2019. This petition shall also be considered fresh representation by the respondent no.2.
With these observations, present petition is disposed of.
