Heard learned counsel for the petitioner.
This petition has been preferred seeking the following reliefs:-
"(i) Issue a writ, order or direction in the nature of mandamus commanding respondent no. 2 to withdraw the recovery certificate issued on 4.9.2003 and provide true and correct statement of account.
(ii) Issue a writ, order or direction in the nature of mandamus commanding respondent no. 3 to provide copy of citation to petitioner."
On 5 March 2004, a learned Judge of the Court had granted an interim protection to the petitioner subject to the deposit of Rs. 25000/-. According to the learned counsel this condition was complied with. This interim order has continued till date. From the counter affidavit which has been filed on behalf of the respondent Bank and more particularly paragraph 3 thereof, the default in complying with the repayment schedule is set forth. This default is not disputed. In view of the above, the Court finds no ground to issue the writs as prayed for.
The writ petition is dismissed.
