Heard learned counsel for the petitioner; Sri Nitin Sharma, learned counsel for the complainant and the learned A.G.A.
This writ petition has been filed praying for the following reliefs:
"(i) A writ, order or direction in the nature of certiorari quashing the impugned First Information Report dated 24.6.2021 registered as Case Crime No. 267 of 2021, under Sections 420, 406, 504, 506 IPC, Police Station- Jhinjhana, District- Shamli (Annexure No. 1 to this writ petition).
(ii) A writ, order or direction in the nature of mandamus commanding the respondents not to arrest the petitioner in pursuance of impugned First Information Report."
After the arguments were heard at some length, learned counsel for the petitioner states that the petitioner wants to withdraw the writ petition with liberty to apply for anticipatory bail.
Learned A.G.A. and learned counsel for the complainant have no objection to the aforesaid request of the petitioner.
In view of the aforesaid, the writ petition is disposed off with liberty to the petitioner to apply for anticipatory bail in accordance with law.
It is made clear that we have not expressed any opinion on merits of the case of the petitioner.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the petitioner alongwith a self attested identity proof of the said person (preferably Aadhar Card) mentioning the mobile number to which the said Aadhar Card is linked.
The concerned Court shall verify the authenticity of such computerised copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
