1. Undisputably, in respect to certain commercial dispute between the parties, an Arbitrator was appointed by the parties who initiated proceedings on 14.10.2016. While the mandate of the Arbitrator so appointed was to expire on 7 April 2018, the opposite parties, namely Indian Oil Corporation Limited (IOCL) filed Application No. 58 of 2018 seeking extension of time for the Arbitrator to make the award.
2. The aforesaid application was not resisted by the present applicant. Consequently, by order dated 17.05.2018, this Court extended the time by six months. The time so extended expired on 17.11.2018.
3. In such facts, it has been pleaded that the arbitration proceedings are at the final stage of conclusion and only the award is required to be pronounced. In such circumstances, further extension of time has been prayed.
4. In all fairness, Ms. Archana Singh, learned counsel appearing for the IOCL has not raised any objection to the extension of time as prayed in such facts.
5. Accordingly, the present application is disposed of, allowing three months' further time from 17.11.2018 to the Arbitrator to make the award.
