Heard learned counsel for the petitioner.
The petitioner has preferred present petition under Article 227 of the Constitution of India with the prayer to set aside the order dated 08.02.2021 passed by trial court/Civil Judge (S.D.), Mathura on 23Ga application in Civil Suit No.143 of 2020 (Manoj Kumar Agarwal Vs. Smt. Gunjan Agrawal and another).
After some arguments, a prayer has been made by counsel for the petitioner to dismiss present petition with liberty to file an appeal as provided under Order 43(1) (r) C.P.C.
Accordingly, present petition is dismissed as not pressed with the aforesaid liberty.
Office is directed to return certified copy of the order to the learned counsel for the petitioner after retaining photo-copy of the same.
