Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the learned Judicial Magistrate-Ist, Bhadohi at Gyanpur to decide the Complaint Case No. 241 of 2011 (Gun Sagar Vs. Pratima Devi and others), under Sections 494, 419, 420, 468, 342 IPC, Police Station Oonjh, District Bhadohi within stipulated period.
Learned counsel for the applicant has submitted that the proceedings of the present case is pending since the year 2011, however, subsequently Opposite Party No.2 has filed an application under Section 482 CrPC No. 20722 of 2016 before this Court, in which proceedings were stayed by this Court, however, thereafter the aforesaid application under Section 482 CrPC has been dismissed for non-prosecution vide order dated 13.08.2019.
In view of the above, learned Judicial Magistrate-Ist, Bhadohi at Gyanpur is expected to make all endeavours to decide the aforesaid case as expeditiously as possible, preferably within a period of one year from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties and there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
