Order on C.M. Correction Application No. 2 of 2019 The petition was filed with a prayer to command the Civil Judge (J.D.), Kaushambi to decide the application for temporary injunction filed by the petitioners under Order 39 Rule 1 & 2 numbered as Paper No. 6-C, in Original Suit No. 935 of 2019 within the time fixed by this Court but the order erroneously records that the prayer is for decision of the original suit itself.
In view of the aforesaid, the order dated 10.12.2019 is corrected and the following order shall be read in place of the order dated 10.12.2019 :-
"Heard learned counsel for the petitioners.
The present petition has been filed by the petitioner praying for a direction to the Civil Judge (Junior Division), Kaushambi to decide the application for temporary injunction filed by the petitioners under Order 39 Rule 1 & 2 numbered as Paper No. 6-C, in Original Suit No. 935 of 2019.
Considering the circumstances of the case, the Civil Judge (Junior Division), Kaushambi is directed to decide the application, i.e., Paper No. 6-C without granting any unnecessary adjournment to either of the parties, in case, there is no legal impediment in deciding the aforesaid application.
With the aforesaid direction, the petition is disposed of.
It is clarified that the Court has not expressed any opinion regarding the claim of the petitioners."
The correction application is disposed of.
