Order:
At the interlocutory stage, the Writ Petition is taken up for hearing and disposal with the consent of the learned Counsel for the parties.
This Writ Petition is filed for the following substantive relief:
“ t o issue an appropriate Writ, order or direction, more particularly one in the nature of Writ of Mandamus, declaring action of the respondents 3 and 4 in not issuing way bills/Transport permits to the petitioner to quarry and transport sand from Kothapeta sand Reach, Kanchikacherla Mandal, Krishna District till 26- 12-2007 and further demanding to pay Rs. 36/- per cum towards the sand being quarried, based on a memo dated 19-04-2007 issued by the 2nd respondent, as arbitrary, illegal, colourable exercise of power, violative of the A.P. Minor Mineral Concession Rules, 1966, violative of the conditions of the lease agreement executed in Form-G1, violative of the Fundamental Rights guaranteed under Articles 14 and 19 of the Constitution of India and consequently direct the 4th respondent to issue way bills/ transport permits to the petitioner to quarry and transport sand from Kothapeta sand Reach.”
It is not disputed by the learned Counsel for the parties that the issue raised in this Writ Petition is similar to the one raised in Writ Petition No.17186 of 2007, which was disposed of by this Court by order, dated 14-06- 2010.
Following the said order, this Writ Petition is allowed with the direction that the reasons and directions contained therein shall form part of this order.
