Heard learned counsel for the petitioners and counsel appearing for the contesting respondent no. 4.
The writ petition arises out of proceedings for demarcation and seeks a writ of certiorari for quashing the order dated 18.08.2018 passed by the Sub Divisional Officer and the order dated 26.07.2019 passed by the Additional Commissioner whereby, the order of the Sub Divisional Officer has been affirmed.
The proceedings for demarcation under Section 41 of the Uttar Pradesh Land Revenue Act are summary proceedings.
The orders passed therein are subject to final order passed in regular title proceedings.
Under the circumstances, the writ petition is disposed of observing that the petitioner, in case so advised, to file a suit for declaration.
