Heard Mr. Shiv Ram Misra, learned counsel for the petitioner and Mr. P. Paul, learned counsel for respondents-State.
Counsel for the petitioner submits that he has instructions not to press the first and second prayers in the writ petition and prays for disposal of the petition in terms of the order dated 19.10.2016 passed in Writ-C No. 49981 of 2016.
Prayers (i) and (ii) of the writ petition are rejected as not pressed.
So far as the other prayer is concerned, the order dated 19.10.2016 reads thus:
"The learned counsel appearing on behalf of the petitioner, Mr. Amit Shukla, learned counsel for the respondent no. 7 and the learned Standing Counsel state that the issue which is raised in these proceedings would stand governed by the judgment of a Division Bench of this Court in Shyam Sunder vs. State of U.P. and Ors. (Writ-C No. 539 of 2015) dated 29 January 2015.
We, accordingly, dispose of the petition in terms of the operative directions in the judgment dated 29 January 2015 which reads as follows:
"We, accordingly, direct that in case the petitioner makes an application to the Taxation Officer/Assistant Regional Transport Officer with all the relevant documents, the prescribed fees and a certified copy of this order, the application shall be forwarded to the Regional Transport Officer who will pass necessary orders within a period of one month of the receipt thereof. For a period of two months from today or until a decision is taken by the Regional Transport Officer, whichever is earlier, no steps shall be taken for the enforcement of the recovery citation dated 24 December 2014"
The petition is, accordingly, disposed of. There shall be no order as to costs."
This petition is disposed of in terms of the aforesaid order.
