Heard learned counsel for the petitioner.
Present writ petition has been filed seeking a direction to the authorities concerned i.e. Additional Civil Judge (S.D.), Court No. 5, Agra to decide Application 100-C of the defendant/petitioner within a stipulated period.
In the facts and circumstances of the case, the present writ petition is finally disposed of with the direction to the Additional Civil Judge (S.D.) Court No. 5, Agra to expedite the hearing of the aforesaid application and decide the same on its own merit, in accordance with law, expeditiously, preferably within a period of four months, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
It is made clear that this Court has not considered the merits of the claim of the petitioner.
With the aforesaid observations/ directions, the present writ petition is finally disposed of.
