Heard Sri Ajay Kumar Dwivedi, learned counsel for the applicant and Sri G.P. Singh, learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been filed with a prayer to direct the court below to consider the Bail Application of the applicant on same day in S.S.T. No. 10 of 2019 arising out of Case Crime No. 304 of 2017, P.S. Kuthaund under Sections 182 and 211 I.P.C., District Jalaun.
It is prayed by learned counsel for the applicant that order may be issued to the trial court to consider his bail application same day. When enquired from him whether any Bail Application has been moved by him in the said case, he did not reply in affirmative, hence prayer for such direction is rejected.
I have gone through the impugned order dated 14.06.2019.
It appears that Special Judge, S.C./S.T. Act, Jalaun has issued summons against the accused applicant whose Protest Petition has been rejected against the F.R. and against him summoning order has been issued under Section 182 and 211 I.P.C.
After having gone through the said order, I do not see any infirmity in the same. However, in case the applicant appears before the court below within 30 days from today and moves an application for bail, the same would be disposed of in accordance with law. For a period of 30 days, no coercive action shall be taken against the accused applicant in the aforesaid case. But if the accused does not appear before the court below within the said time period, the court below shall take coercive steps to procure his attendance.
With this direction, this Application under Section 482 Cr.P.C. is disposed of.
