JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The basis of the present petition is the alleged non-compliance to the order dated 20.07.2007 passed by this Court in Special Civil Application No.16089/07, whereby the direction was given to the respondents therein to decide the representation.
Upon hearing the learned advocate appearing for the petitioner Mr.Majmudar, Mr. Nanavati, learned AGP for respondent No.1, Mr. Rashesh Rindani with Mr.Chhayya for respondent No.2 and Mr.Mirza with Mr.Marshall for respondent No.3, it appears that there is no specific direction to the particular respondent to decide the representation. However, Mr.Majmudar, learned counsel appearing for the petitioner states that the Departmental/Divisional Manager of GIDC had to decide the representation. He further states that the copy of the representation with the due acknowledgment dated 10.08.2007 is produced at Annexure-II with the present petition.
Under these circumstances, it is directed that the respondent No.2 shall decide the representation, copy whereof is produced at Annexure-II with the present petition pursuant to the direction 20.07.2007 passed by this Court in Special Civil Application No. 16086/07 and others within a period of six weeks from the receipt of the order of this Court. It is further observed that in the event the decision is taken by the respondent, the same shall be communicated to the petitioner or his representative by Regd.A.D. Post. It is also observed that in the event such direction is not complied with, the petitioner shall be at the liberty to file appropriate application.
Disposed of accordingly. D.S. to respondent No.2.
