1.0 This petition is directed against the judgement and award dated 22nd July 2009 passed by learned Presiding Officer, Labour Court, Vadodara in Reference (LCV) No. 338 of 2003 whereby the said reference came to dismissed.
2.0 According to the petitioner he was working as store keeper with respondent No.2 since 1st January 1991. On 7th March 2001 his services came to be removed orally by respondent No.1 who was a contractor. He therefore raised a dispute which was numbered as Reference (LCV) No.338 of 2003.
3.0 Heard the learned Advocate for the petitioner at length. The Labour Court has considered the matter in greater details and definitely come to a conclusion that the the petitioner has failed to prove that his service was orally terminated on 7th March 2001. Further it is found from the record that there is no industrial dispute between the petitioner and the respondent. I am in complete agreement with the reasoning adopted and findings arrived at by the Tribunal. The petition is therefore, dismissed.
