Application for bail under Sec.439 of Cr.P.C. 2. Petitioner is the 2nd accused in Crime No.167 of 1999 of Thrissur West Police station which is pending in S.C. No.453 of 2012 on the file of the 3rd Additional Sessions Court, Thrissur.
3. Prosecution case is that the petitioner is involved in offences punishable under Secs.341, 323, 307 and 302 read with Sec.34 of IPC. It is alleged that on 24.04.1999 at about 4 p.m. at Kottappuram junction in MG Road, Thrissur, the petitioner along with other accused persons in furtherance of their common intention, wrongfully restrained CWs1 and 2 and caused death of one Joshi. They caused hurt to CW2 as well.
4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
5. Learned Public Prosecutor opposed the bail application contending that the petitioner is involved in Bail Appl. No.6506 of 2014 2 five other cases with grave allegations.
6. Considering the antecedents of the petitioner and the fact that the matter is is pending trial before the Sessions Court, I decline bail to the petitioner. However, I direct the Court below where the matter is pending to expedite the trial and try it as expeditiously as possible, at any rate within a period of six months.
