The petitioners are seeking conversion of the Nazul land into freehold in accordance with the Government Order dated 01.12.1998.
The petitioners have already deposited 25% of the amount and it appears that for the balance 75% demand notice has not been issued though the order dated 20.06.2017 indicates that the petitioners have to pay Rs.65,35,789/- and 12% interest for the delay.
The petitioners and their predecessors in interest had earlier filed Writ Petition No.9353 of 2001, Mohan Lal & others Vs. State of U.P. & others for the freehold rights which was disposed of on 05.08.2015 with the direction to consider the application of the petitioners for grant of freehold rights preferably within a period of two months.
Learned counsel for the petitioners submits that the petitioners are ready or willing to deposit the 75% of the amount with interest provided a demand notice in that regard is issued and served upon them.
In view of the aforesaid facts and circumstances, we dispose of the writ petition with the direction to the respondent No.2 to issue a demand notice upon the petitioners for the 75% of the amount with interest, if any afresh within a period of one month and on issuance of said demand the petitioners will make the deposit within two weeks thereafter.
On deposit of the said amount the application of the petitioners for freehold rights shall be considered in accordance with law and the Government Order dated 01.12.1998 as may have been modified from time to time as expeditiously as possible.
