JUDGMENT / ORDER

On the last date, viz. 8th July 2011, learned advocate for the applicant was to serve a copy of this application to learned advocate Mr.H.K. Acharya for the respondent- workman.
2. The learned advocate for the applicant states that a copy of this application is now served to learned advocate Mr.H.K. Acharya, but it appears that Mr.H.K. Acharya has yet not received any instructions from the original respondent- workman.
Learned advocate for the applicant- original petitioner states that notice of sad demise of learned advocate Mr.K.S. Acharya is already issued to the respondent- workman and it was expected that the respondent- workman will either appear personally or through an advocate, but that has not happened so far.
3. Learned advocate for the petitioner submitted that the relief sought for in this application is innocuous. It is prayed that the petition of 2003 be listed for final hearing at an early date. Agreeing to the submissions made by the learned advocate for the applicant - original petitioner, the application is allowed. The main matter be listed for final hearing on 9th August 2011.
