After hearing the learned advocate for the petitioner and after going through the materials on record, we find that the petitioner has made out a strong prima facie case to have an order staying the operation of the assessment order, inasmuch as, the assessment order has been passed before deciding the objections raised by the assessee against the reason for re-opening of assessment which was supplied to it.
We, accordingly, pass an interim order in terms of prayer 7(B) for a period of four weeks from today.
Let the matter appear on 28th February 2012. Direct service is permitted.
