Kedilaya, Advocate) This Criminal Petition is filed u/s 482 of Cr.P.C., praying to Modify / enhance the maintenance amount from Rs.8,000/- to Rs. 25,000/- from the date of application by modifying the order dated 06.09.2013 in Crl.A.No.116/2013 passed by the Additional Session Judge, F.T.C.-X, Bengaluru.
This Criminal petition coming on for Admission, this day, the Court made the following:
O R D E R Learned counsel for the petitioner is absent. Learned counsel for the respondent has filed a memo. The memo reads as under:
“The respondent humbly submits that the above petition is preferred seeking enhancement of the monthly maintenance awarded to the petitioner under the D.V.Act. But, in view of the dismissal of the petition filed under the D.V.Act in C.Misc.No.65/2012 by the MMTC-IV on 27/03/2018, the above Criminal Petition does not survive for consideration. Hence, it is prayed that the above petition may kindly be dismissed as infructuous, in the interest of justice and equity.”
Memo is placed on record.
In view of the above facts, nothing survives for consideration in this petition. Hence, petition is dismissed as having become infructuous.
