The prayer in the writ petition is to issue a direction to the respondent no.3 to disburse the compensation determined by the competent authority.
Alongwith the writ petition, certain representations filed in the month of September and December, 2020 have been appended, but in none of the paragraphs of the writ petition it is disclosed that the petitioner has approached the competent authority for disbursement of compensation by moving a proper application under Section 3-H of the Act, 1956 appending the documents of title/right in the land-in-dispute.
We do not find it a fit case for issuance of mandamus. However, liberty is granted to the petitioner to approach the competent authority by moving a proper application.
For the above, the writ petition is disposed of with the direction that in case, the petitioner applies the competent authority by moving proper application within three weeks, he shall be under obligation to take an expeditious decision strictly in compliance of the Section 3-H of the National Highways Act, 1956 for disbursement of compensation.
