...Respondents This WPHC is filed under Articles 226 and 227 of Constitution of India, praying to issue a writ of Habeas Corpus directing the respondents to produce the husband of the petitioner by name Sandeep J, S/o Late Jagannathachar, aged about 30 years, before this Hon’ble Court by in person.
This WPHC coming on for Preliminary Hearing this day, BAJANTHRI J, made the following:
ORDER In the instant petition, petitioner pleaded that the detenue – Sandeep J, was missing from 29.09.2019 at about 08.30 P.M. when he went to Udaya Hotel, Hiriyur, to have his meal. Respondent No.3 is stated to have forcibly taken the petitioner in a private vehicle. Thus, the present petition.
2. Learned counsel for the respondent/State on instructions furnished documents that the petitioner is involved in Crime No.87/2019 for the offences under Sections 437 and 380 of IPC. Thus, it is evident that detenue is involved in criminal case.
Accordingly, writ petition stands disposed of.
