Heard learned counsel for the petitioner, learned Standing Counsel representing State and perused the record.
The present writ petition has been filed beseeching the expeditious disposal of Revision No. 103/M/2018 (Gayasuddin Vs. State of UP & another) under Section 219 of the UP Land Revenue Act pending in the court of Commissioner, Azamgarh (respondent No. 3).
It is submitted by the counsel for the petitioner that the petitioner has preferred a revision dated 20.12.2018 against the order dated 14.12.2018 passed by the Sub-Divisional Officer in a proceeding under Section 38 of the UP Revenue Code, 2006, which is pending protracted and no fruitful efforts are being taken by the court concerned to decide the aforesaid revision at the earliest.
Learned Standing Counsel has no objection in case a direction is issued for early disposal of the revision.
In this conspectus, as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case as mentioned in the present writ petition, with a direction to Commissioner, Azamgarh (respondent No. 3) before whom the aforementioned matter is pending disposal, to decide the same expeditiously, preferably, within a period of four months from the date of receipt of a certified copy of this order.
It is expected that it should be decided by a reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments to either of the parties.
With the aforesaid direction, present writ petition is disposed of.
