Petitioners filed an application for the correction of record in the year 2018. A report was submitted in favour of the petitioner on 24.11.2018. However, despite this report the application for the correction of record was rejected on 16.11.2018 against which order the petitioner filed an appeal under Section 38(4) of U.P. Revenue Code, 2006. Along with the appeal, the petitioners had also filed an application for staying the dispossession of the petitioner. The grievance of the petitioners is that no orders were being passed on the application for temporary injunction.
It is, therefore, directed that orders would be passed on the application filed for temporary injunction by the petitioner within a period of 10 days from the next date fixed in the appeal.
For a period of three weeks status quo as of today shall be maintained. It is further provided that the appeal filed by the petitioner shall be decided within a period of two months, thereafter, if there is no other legal impediment.
The writ petition is disposed of.
