Under order dated 30.5.2018 in Writ-A No.20564 of 2018, the complaint filed by the applicants in relation to illegal encroachment over Gaon Sabha land was required to be decided by the Collector within one month from the date of receipt of certified copy of the order.
It is not disputed by learned counsel for the applicants that proceedings for eviction from Gaon Sabha land is to be initiated before the Tehsildar/Assistant Collector Ist Class under Section 67 of U.P. Revenue Code, 2006. He therefore, seeks liberty to file application before the Tehsildar for doing needful in the matter.
Having regard to the above stand taken by learned counsel for the applicants, instant contempt application is disposed of by observing that in case any such application is filed, the Tehsildar shall be bound by the direction issued by the writ court and shall endeavour to decide the same within the time frame prescribed.
