The matter being Criminal Misc. Application No. 4188 of 1997 does not seem to be part of the group and therefore, this is wrongly notified along with other matters. Accordingly, the said matter is separated from the group and is adjourned to 22.8.2008 as Shri Raval has filed leave note.
Rest of the matters are cognate matters and in these matters, Shri Naik, learned counsel requests for time only for a day so as to ascertain with regard to out come of the probate proceedings. The time is granted only upto tomorrow i.e. 22.8.2008 with a specific observation that matters shall be proceeded with even if there is no instructions with regard to probate proceedings, as granting of time has been objected by Shri Nanavati, learned APP as the investigation is stayed.
Office is directed not to show the name of Shri Gandhi in Criminal Misc. Application No. 1507 of 1998 and place copy of this order in Criminal Misc. Application No. 4188 of 1997 and others.
