The petitioner has preferred this writ petition for issuance of a writ of mandamus to the first respondent, the Director of Consolidation and District Magistrate, Jaunpur, to decide its representation dated 07th December, 2017.
The grievance of the petitioner is that the consolidation authorities without considering the grievances of the tenure holders of the village and without deciding the objection raised by them under Section 9A of the Uttar Pradesh Consolidation of Holdings Act, 1953 have committed irregularity in the consolidation proceedings. The petitioner has pointed out several other irregularities in the writ petition.
I have heard learned counsel for the petitioner and learned Standing Counsel, who appears for all the respondents.
Having due regard to the facts and circumstances of the case, I am of the view that no interference is called for under Article 226 of the Constitution of India. Records show that the petitioner has made a representation to ventilate its grievance before the authority concerned. In my view, the Uttar Pradesh Consolidation of Holdings Act, 1953 is a complete Code in itself, hence, the petitioner may take recourse to the remedy available under the said Act.
With the aforesaid observations, the writ petition is dismissed.
Needless to say that it is open to the authority concerned to consider the grievance raised by the petitioner in accordance with law.
No order as to costs.
