Heard learned counsel for the parties.
This application under Section 482 of the Code of Criminal Procedure, 1973 (in short 'Code') has been filed on behalf of the applicant with a prayer to quash the proceedings of Criminal Case No. 5546 of 2016 (State v. Ramji and others), arising out of Case Crime No. 522 of 2016, under Sections 376, 323, 504 and 506 of the Indian Penal Code, 1860, Police Station - Cholapur, District - Varanasi, pending in the court of Additional Chief Judicial Magistrate-I, Varanasi.
Learned counsel for the applicant contended that trial is proceeding in this case.
No cause of action survives.
Accordingly, the instant application stands rejected as infructuous.
