(Per : HONOURABLE MR.JUSTICE V. M. SAHAI) This is an application for condonation of delay of 530 days in filing Letters Patent Appeal.
2. Heard learned counsel for the applicant. Though served, no affidavit-in-reply to the present application is filed by the respondents.
3. Considering the contents of the application, it cannot be said that the delay caused in filing the Appeal has remained totally unexplained. Therefore, we are of the view that the delay caused in filing Letters Patent Appeal deserves to be condoned. Accordingly, the application is allowed. Delay is condoned. Rule is made absolute.
4. Registry is directed to list the Letters Patent Appeal for admission hearing on 13.2.2012.
