[1] Today when the matter is taken up, learned advocate for the petitioners and Mr.Nanavati, learned advocate for the Corporation have drawn attention of the Court to different orders passed earlier for rehabilitating slum dwellers.
[2] Mr.Mehta, learned advocate for the petitioners took the Court through order passed by the Hon'ble Supreme Court and pointed out that it was for the State Government to take decision on the scheme called as Rehabilitation and Redevelopment of Slums, 2010. Mr.Mehta says that as on today nobody knows whether State Government has taken any decision or not and it is for the State Government to approve or disapprove the scheme. Mr.Mehta, learned advocate says that petitioners and other hutmen dwellers are ready to evict the premises.
[3] It would be in the interest of justice to atleast know from the Corporation as well as State Government as to what decision State Government has taken on the said scheme.
[4] Under the circumstances, Ms.Thakore, learned AGP is requested to take instructions from the State Government in respect of above said scheme. To enable Ms.Thakore, to take instructions the matter is now kept on 10.01.2012.
[5] Interim relief granted earlier and operation till today shall stand extended till 10.01.2012.
[6] Mr.Nanavati, learned advocate who is appearing on oral instructions, shall file his appearance by Monday.
