This Court made the following:
THE HON'BLE SMT JUSTICE T. MEENA KUMARI & THE HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY CC NO.97 OF 2010 ORDER: (Per Hon’ble Smt Justice T. Meena Kumari) The Contempt Case has been filed complaining willful disobedience of judgment dated 21.1.2009 in WA No.17 of 2009.
Originally, the petitioner herein filed WP No.18854 of 2006 assailing the proceedings dated 13.6.2006 issued by the Municipal Corporation of Hyderabad, whereby and whereunder, the respondents directed him to exclude an extent of 73.00 sq. metres and submit the house building permission application. The learned single Judge disposed of the writ petition directing the respondents to consider the application of the petitioner for building permission subject to his undertaking that he will not claim structures compensation in the event of 73.00 sq. metres of land is being acquired by the respondent- Corporation for public purpose. Aggrieved by the direction of undertaking, the petitioner herein filed the above writ appeal. The Division Bench modified the order of the learned single Judge deleting the direction as to the undertaking to be given by the petitioner.
Now, the present contempt case is filed complaining that the respondents-authorities failed to comply with the orders of this Court.
At this stage, it is brought to the notice of this Court by the learned Standing Counsel that the application of the petitioner seeking permission was considered.
Recording the above submission, the contempt case is closed.
However, it is made clear that the petitioner can agitate his rights, if his application was not considered as stated by the learned Standing Counsel. No order as to costs.
