JUDGMENT / ORDER

RULE.
Learned Additional Public Prosecutor Ms. C.M. Shah waives service of notice of Rule for the respondent - State.
The applicant has preferred this application for grant of temporary bail for a period of 30 days on the ground that the wife of the applicant is suffering from acute appendicitis and is required to undergo abdominal hysterectomy and internal appendectomy.
It appears that the applicant is in jail since last more than 10 years. Besides a statement has also been recorded by the police authorities wherein it has been stated by the wife of the applicant that though her brother lives nearby her residence, she has no relations whatsoever with him. It is also submitted that the presence of the applicant is necessary at such a juncture.
In view of the facts and circumstances of the case, this application is partly allowed. The Jail Authority is directed to release the applicant on temporary bail, on the usual terms and conditions for a period of seven (7) days, from the date of his release. The applicant shall surrender before the jail authority immediately after the aforesaid period is over.
Rule made absolute to the aforesaid extent. Direct Service is permitted.
