Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and Sri Azad Rai, learned counsel has accepted notice for the gaon sabha and perused the record.
Present petition has been filed with a prayer to direct the respondent no. 1- Sub Divisional Officer, Handia, Allahabad to decide the Case No. T201802030405484 of 2018 (old number 1393) (Fateh Bahadur Singh vs. Gaon Sabha Bigahiya and others) filed under Section 41 of Land Revenue Act within stipulated period of time.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no. 1 to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of three months from the date of production of a self verified copy of this order and no unnecessary adjournments shall be granted to the parties provided there is no legal impediment as well as the functioning of the court is not affected by any reason related to COVID-19 Pandemic as well as the lawyers are not abstaining from the judicial work.
It is further provided that the dates on which the lawyers are abstaining from work shall be treated to be excluded from the period within which the proceedings are directed to be completed and in case the parties appear in person, the authority concerned shall proceed to conclude the proceedings.
With the aforesaid observations/ directions, the present petition is finally disposed of.
