(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail on the ground of sickness and operation of his father.
Pursuant to the earlier order passed by this Court, learned APP, Mr.Pandya, based on the report of Superintendent of Police, Kheda has submitted that the father of the applicant was treated as an outdoor patient and date of operation is not fixed.
From jail remarks, we find that whenever the applicant-convict was released on temporary bail or on furlough leave, he has surrendered to the jail authorities in time.
Considering the totality of the facts, it is ordered that the applicant-convict shall be enlarged on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs.5,000/- with one surety of like amount and with the further direction that he shall surrender to the jail authorities on expiry of the period granted by this Court.
Application is allowed to the aforesaid extent. Rule made absolute.
