Heard Sri N.I. Jafri, learned counsel for the applicant and Sri Amrit Raj Chaurasia, learned A.G.A. for the State.
The first and second bail application of the applicant was rejected by this Court vide order dated 26.11.2014 and 22.4.2016 respectively with a direction to the trial court to conclude the trial of the present case, which has not been concluded as yet, hence this third bail application has been moved on behalf of the applicant.
The new ground which has been argued by the learned counsel for the applicant is that four prosecution witnesses have been examined by the trial court but the trial has not yet been concluded and the applicant is in jail since 7.4.2014.
Learned A.G.A. has vehemently opposed the prayer for bail and has submitted that the trial is in progress and the first two bail applications were rejected by this Court on merits.
Taking into account the fact that the first two bail applications of the applicant was rejected by this Court on merits, I find no good ground for grant of bail to the applicant Farhan involved in Case Crime No. 316 of 2014 under Section 302, 452, 504 and 506 I.P.C., police station Kotwali Dehat, District Bulandshahar.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same on day to day basis strictly in accordance with the provisions contained in Section 309 Cr.P.C. within a further period of six months from the date of production of a certified copy of this order.
