Heard learned counsel for the petitioner.
The instant petition has been filed by the petitioner seeking following relief:
"(i) To issue a writ, order or direction in the nature of mandamus directing the (Respondent No.1) learned Additional Chief Metropolitan Magistrate, Court No. 4, Kanpur Nagar to decide the Original Suit No. 13 of 2010 (Shamim Ahmad & others Versus Smt. Raqshanda & others), for eviction, expeditiously within stipulated period prescribed by this Hon'ble Court."
I have perused the record as well as the order-sheet. From the order-sheet it transpires that the case is being adjourned on one pretext or the other and only the dates are being fixed.
Expeditious disposal of a case is the right of every litigant and it is expected from every court to endeavour to dispose of a case pending before it expeditiously.
Having regard to the facts and circumstances of the case, the Court below is directed to make all possible efforts to decide the aforesaid case in accordance with law expeditiously fixing short dates, without giving any unnecessary adjournment to either of the parties, provided there is no legal impediment.
With the aforesaid direction, this application is finally disposed of.
