Heard learned counsel for the petitioner and Shri Pankaj Rai, learned Additional Chief Standing Counsel for the State respondents.
In pith and substance, the petitioner is before this Court with the request to ask the Sub Divisional Magistrate, Shikohabad, District Firozabad to decide the objection dated 14.05.2018 filed by the petitioner against the notice dated 10.05.2018, expeditiously.
Learned counsel for the petitioner states that the impugned notice dated 10.05.2018 has been issued against the petitioner asking him to vacate the property in question and there is every likelihood that petitioner may be dispossessed during the pendency of the said objection.
No useful purpose would be served in keeping the writ petition pending.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Sub Divisional Magistrate, Shikohabad, District Firozabad to decide the said objection expeditiously, preferably within a period of two months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost but certainly after according opportunity of hearing to all the stake holders in the matter. It is made clear that till the disposal of the same, no coercive action shall be taken against the petitioner.
