Learned counsel for the petitioners at the very outset submits that he wants to pay outstanding dues of the bank in respect of which recovery citation has been issued by Tehsil authorities on 30.4.2019 for a sum of Rs.2,54,852/- along with interest.
Sri Sushant, learned Advocate, holding brief of Sri Dharmedra Vaish learned counsel for the bank does not have any objection in case if some installment is facilitated in favour of the petitioner for the payment of dues.
In view of the consent being accorded by the bank the writ petition is disposed of with a direction that no coercive measures shall be taken against the petitioner pursuant to recovery citation dated 30.4.2019 provided:-
(A). The petitioner shall pay Rs.75,000/- by 30th June, 2019. On payment of the first installment the bank shall supply all outstanding dues along with interest payable on the amount of the dues within two weeks thereafter.
(B). The rest amount shall be paid including the amount of the interest to be paid by the petitioner in the next 3 bimonthly installments.
However, no recovery charges shall be realized from the petitioner in respect of the revocery citation issued.
It is, however, made clear that in the event of default of any of the directions contained hereinabove, the protection granted under this order shall seize to exist and bank shall at liberty to proceed in accordance with law to recover the amount.
